WHEN THE PAPER TRAIL BREAKS
How Does Money Get Left Behind?
After a foreclosure or tax sale, the property may be gone—but the financial process isn’t necessarily over. If excess proceeds remain, notices may be sent using addresses contained in existing government, property, or court records. Sometimes that means correspondence continues going to an address connected with the property even though the former owner no longer lives there.
People move. Mailing addresses become outdated. Former owners relocate after losing a property. An owner may pass away. Estates and family circumstances change. Important correspondence may never reach the person who needs to see it. And sometimes the biggest obstacle is much simpler: the person never knew there was anything left to look for.
MOVED AWAY
Notices may be sent using an address that is no longer current.
LIFE CHANGED
Death, inheritance, divorce, relocation, or other changes can break the connection between a person and an old property record.
RECORDS ARE FRAGMENTED
Relevant information may exist across counties, courts, property records, auction records, or government databases.
NEVER KNEW
Sometimes the person simply had no reason to know there was anything left to investigate.
Public record doesn’t always mean obvious record.
Information can be publicly available and still remain unseen by the person it matters to most.
That’s the gap Forged Prosperity was created to help bridge. We research public records, investigate potential connections, locate people who may no longer be where older records point, and help them understand what may still be worth investigating.
Notification procedures, deadlines, entitlement requirements, and disposition of unclaimed funds vary by jurisdiction.
Forged Prosperity LLC is a private company, not a government agency. We are not a law firm and do not provide legal advice. We do not guarantee that funds will be recovered or that any person is eligible to claim funds.
SURPLUS FUNDS EXPLAINED
Money Can Remain After the Sale Is Over
Certain property sales can produce more proceeds than the obligations and costs that must be paid from the sale. When that happens, funds may remain for an entitlement review.
Depending on the jurisdiction and circumstances, remaining proceeds may be called surplus funds, excess proceeds, excess funds, overbid funds, foreclosure surplus, or tax sale surplus.
A potential surplus is not automatically a payout to one person. Ownership interests, liens, priority claims, estates, court orders, costs, and applicable law can affect distribution.
Time can matter, too.
Depending on the jurisdiction and the type of proceeding, surplus funds can sit with a county, court, clerk, treasurer, sheriff, trustee, or other custodian for a limited period, and if they remain unclaimed they may be transferred to a state unclaimed-property program, distributed according to governing statutes, or otherwise disposed of under local law; because deadlines and claiming procedures vary widely by state and by the nature of the case, time is of the essence — missing filing windows or notice requirements can forfeit rights to recovery or shift the funds into alternate custody or automatic distribution.
Don’t Take Our Word for It. Verify It.
